1. Agreement to Terms

By accessing or using the Start Kit platform at startkit.ca, you agree to be bound by these Terms of Service. If you do not agree, you may not use the service.

2. Description of Service

Start Kit provides a platform to help Canadian businesses get started and manage their operations. This includes guided workflows for incorporation, domain registration, email setup, HR, payroll, finance, legal, insurance, and other business functions. Features are provided through a modular system that you activate based on your needs.

3. Account Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 18 years old to use the service
  • One person or legal entity may maintain no more than one account
  • You are responsible for all activity that occurs under your account

4. Acceptable Use

You agree not to:

  • Use the service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the service
  • Interfere with or disrupt the service or its infrastructure
  • Upload malicious code, viruses, or harmful content
  • Impersonate another person or entity
  • Use automated means to access the service without our permission

5. Intellectual Property

The Start Kit platform, including its design, code, content, and branding, is owned by Start Kit and protected by Canadian and international intellectual property laws. You retain ownership of any data you input into the platform.

6. Third-Party Services

Start Kit integrates with third-party services to provide certain features (e.g., domain registration, email providers, payment processors). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability or actions of third-party services.

7. Payment & Billing

Certain features of the service may require payment. By subscribing to a paid plan, you agree to pay the applicable fees. All fees are in Canadian dollars (CAD) unless otherwise stated. We reserve the right to change pricing with 30 days' notice.

8. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, either express or implied. Start Kit does not provide legal, financial, tax, or accounting advice. The information and tools provided through the platform are for general guidance only. You should consult qualified professionals for advice specific to your situation.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Start Kit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill.

10. Termination

You may close your account at any time. We reserve the right to suspend or terminate your account if you violate these terms. Upon termination, your right to use the service ceases immediately. We will make your data available for export for 30 days following termination.

11. Governing Law

These terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of British Columbia.

12. Changes to Terms

We may modify these terms at any time. We will provide notice of material changes via email or through the platform. Continued use of the service after changes constitutes acceptance of the updated terms.
